Terms & Conditions

By engaging my services, you acknowledge that you have read, understood, and agreed to these terms for the duration of our project.

I reserve the right to review and change any of these Terms at my discretion; changes take effect immediately upon being shared or updated.

1. Our Professional Relationship

The Fitted Home provides professional organising services at the address the client has provided. This Agreement commences on the date of signing or at booking, and remains in effect until the agreed services are completed.

2. Privacy & Confidentiality

Confidentiality: All information shared is strictly confidential. I will not disclose any information regarding your household or business to third parties unless required by law or to process payments.

Any written action plans I provide are for your personal use and may not be disclosed to others without my consent.

Property: No items, documents, or waste will be removed from your premises without your express consent.

Photography: Before-and-after photos are essential to the growth of The Fitted Home. However, I will not share any photos of your space without your express written consent. Any shared photos will be anonymised to protect your privacy.

3. Access & Unattended Work

Site Access & Security: Services are conducted in your presence unless written authorisation is provided granting me access to the premises alone. By authorizing this access, you agree to indemnify The Fitted Home against claims of loss or theft, barring evidence of criminal intent or negligence.

4. Fees, Payments, Cancellations & Refunds

Pricing: These terms apply to the pricing described in your Quote, Agreement, or confirmation email. All prices are un AU$.

Deposits: To secure and confirm your session, a deposit of $100 is required.

Balance: The balance of your payment, including reimbursement for goods purchased on your behalf, is due at the end of our last session unless otherwise agreed.

Payment options: Payments can be done by bank transfer to The Fitted Home or PayID.

Late payments: Invoices 30 days overdue will be referred to debt collection or lawyers. You agree to pay all associated legal and collection fees plus statutory interest.

6. Cancellation and Refund Policy

I understand that life is unpredictable, but as a small business, organisation is key to my operations.

Notice Period: You may cancel or reschedule a session in writing 48 hours prior to the scheduled time by an email or message notification.

Refunds: If notice is given correctly, your fee will be refunded. If notice is given less than 48 hours prior, no refund is provided.

Deposit Forfeiture: Your deposit is forfeited if you fail to reschedule within 30 days, cancel more than three times, or fail to provide 48 hours' notice.

Gift Voucher: If using a voucher and 48 hours' notice is not provided, the deposit amount will be deducted from the voucher value.

Accuracy: If an error is discovered in the description or price of services, I will notify you immediately to allow for a cancellation and full refund.

5. Gift Vouchers

Validity: Gift Vouchers are valid for 3 years from the date of purchase and are subject to The Fitted Home’s standard terms and conditions.

Value: A Gift Voucher acts as a pre-paid financial deposit. This amount is applied toward the total cost of your chosen service at the time of booking.

Non-Redeemable: Vouchers are non-refundable, cannot be replaced if lost, and cannot be redeemed for cash.

6. Session Specifics

Travel: For onsite sessions more than 40km from Medowie (2318), travel fees may apply.

Materials: Storage solutions or equipment purchased on your behalf will be invoiced upon your written approval.

Standard Hours: 9am–5pm, Monday to Friday. Weekend or public holiday sessions may require negotiation and additional fees.

Cooperation: Success depends on your cooperation. I am not responsible for expectations not being met where cooperation is not provided.

Donations: You are responsible for identifying donation items. Once removed, this process is final. I reserve the right to refuse items that are hazardous or too heavy.

7. Workplace Health and Safety (WHS)

Safety: You are responsible for ensuring the work area is safe. You are liable for any injury, loss or damage caused to me while performing services on your premises due to undisclosed hazards or negligence.

8. Liabilities and Damages

Insurance: I hold Public Liability for accidental damage.

Indemnity: You agree to indemnify me against legal claims from circumstances outside my control, including working in private residences where pets or children are present.

This indemnity does not apply to claims caused by my direct negligence or a breach of this Agreement.

9. Consumer Complaints

I value our relationship and encourage friendly discussion as the first step to resolving any concerns. Formal disputes must be submitted in writing and will be responded to within five (5) business days.

10. Governing Law & Signatures

This Agreement is governed by the laws of New South Wales, Australia. We agree that electronic signatures are the legally binding equivalent of handwritten signatures.

11. Declaration

By engaging the services of The Fitted Home, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in their entirety.

You acknowledge that you have freely chosen to engage this service and understand our respective roles and responsibilities. Your booking, payment of a deposit, or commencement of a project acts as your formal acceptance of this agreement for the duration of our work together.

12. Photos & Media Consent

Usage: I understand that The Fitted Home uses "Before & After" photos and videos to showcase the functional transformations of projects. These may be used for the website, social media, and marketing purposes.

Privacy & Anonymity: To protect your privacy, The Fitted Home guarantees that:

Your full name and address will never be shared.
Sensitive items (family photos, mail, or personal documents) will be blurred or removed from the frame before capturing.

Ownership: All media remains the property of The Fitted Home. You are welcome to copies of these photos for your own personal use and "reset" inspiration!

Your Choice:

Consent Given: By selecting "I consent" during booking, you grant permission for the use of anonymous project media.
Consent Withheld: If you do not wish for your project to be used for marketing, please select "I do not consent." This will not affect the quality of service you receive.

Note for Launch Offer Clients: Please note that the "Introductory Portfolio Rate" is specifically offered in exchange for media consent. If you are booking this specific offer, consent is required for the rate to apply.
